The Paycom Employment Practices Case
On August 13, 2021, the United States District Court for the Central District of California granted preliminary approval of a settlement in the lawsuit entitled Cameron Rosetta vs. Paycom Software, Inc. and Paycom Payroll, LLC, Case No. 2:19-cv-8994-AS. The case alleges Paycom does not pay its California-based sales professionals required overtime and that Paycom requires its employees to sign and comply with overbroad non-disclosure, non-disparagement, and non-solicitation agreements and a “likeness waiver” that violates California law.
The settlement, if finally approved, will result in the dismissal of the claims asserted on behalf of a class and groups aggrieved employees under the Private Attorneys General Act (PAGA), each of which are defined in the Stipulation and Settlement of Class and Representative Action.
